GENERAL TERMS AND CONDITIONS – PTBA (Personal Trainer Business Academy)

PTBA (Personal Trainer Business Academy), registered office at Korhoenlaan 18, 1343 AA Almere, The Netherlands. Registered with the Dutch Chamber of Commerce (KvK) under number: 12345678910. Applicable from March 2026.


Article 1 – Definitions

  • Program: Any course, training or study program offered by the institute, including physical and online components.
  • Student: The person enrolling in the program and agreeing to these terms.
  • Agreement: The written or digital confirmation of enrollment and acceptance of these terms.
  • Examinations: Theory and practical tests, portfolios and other assessment moments.
  • The Institute: PTBA.
  • Internship/Portfolio: Practical components forming part of the program.
  • Parties: The student and PTBA staff.
  • Classroom Education: Live, in-person lessons at the Almere location.

Article 2 – Identity and Contact Details

PTBA is registered with the Dutch Chamber of Commerce under number 12345678910 and located at Korhoenlaan 18, 1343 AA Almere. Contact details (email, phone and website) are provided upon enrollment and publicly available.

Article 3 – Applicability

These terms apply to all programs, courses, exams, internships, portfolio activities and services of PTBA. Deviations are only valid if agreed upon in writing.

Article 4 – Formation of the Agreement

4.1 Offers

All offers are non-binding unless stated otherwise. Prices are exclusive of VAT unless specified.

4.2 Execution

The agreement is concluded after enrollment and written or digital confirmation by PTBA. Telephone agreements are not valid. PTBA reserves the right to refuse enrollment.

Article 5 – Right of Withdrawal

Students may cancel within 14 days of enrollment without reason, provided the program has not started.

Article 6 – Tuition Fees and Payment

  • Course fees (including VAT) are clearly communicated upon enrollment.
  • Payment must be made within 14 days of invoice date.
  • Access may be suspended in case of late payment.
  • Study materials and exams are included unless stated otherwise.
  • Resits are charged separately.
  • Travel costs are the responsibility of the student.

Payment Delay

  • First reminder: free, 7 days to pay.
  • Second reminder: €12.50 administration fee.
  • Third reminder: €25 administration fee.
  • Statutory interest and collection costs may apply.

Article 7 – Cancellation and Termination

Cancellation by PTBA

PTBA may cancel due to insufficient participants or force majeure. A full refund or alternative will be offered.

Article 8 – Program Execution

PTBA determines schedule, locations and teachers. Students are responsible for technical equipment for online education.

Online Programs

  • Accounts may be blocked if payments are overdue.
  • Access suspension does not extend the course duration.
  • Diplomas are issued only after full payment.

Attendance (Classroom)

  • Minimum attendance requirement: 80%.
  • Missed lessons may be retaken within 1 year for €60.

Article 9 – Attendance and Study Progress

Insufficient attendance may prevent exam participation. Study progress is monitored and may affect certification.

Article 10 – Internship and Portfolio

Internships and portfolio submissions must comply with guidelines and deadlines.

Article 11 – Examinations

Exams may include theory, practical or portfolio assessments. Resits are possible at additional cost.

Article 12 – Certification

Certificates or diplomas are issued upon successful completion of all requirements.

Article 13 – Complaints and Appeals

Complaints must be submitted in writing. Procedures and timelines are communicated clearly.

Article 14 – Conduct

Professional behavior is required. Suspension may occur in case of violations.

Article 15 – Liability and Safety

  • Participation is at the student’s own risk.
  • PTBA is not liable for damage or injury unless caused by gross negligence.
  • Students are responsible for medical fitness.
  • Students must follow safety instructions at all times.
  • Insurance is the responsibility of the student.

Article 16 – Intellectual Property

All materials remain property of PTBA. Reproduction or distribution is prohibited.

Article 17 – Use of Images

Photos and testimonials are used only with explicit consent.

Article 18 – Privacy

Personal data is processed in accordance with GDPR regulations.

Article 19 – External Partners

Personal data may be shared with exam bodies or internship partners strictly for educational purposes.

Article 20 – Confidentiality

Students and staff must keep confidential information private.

Article 21 – Final Provisions

  • Dutch law applies.
  • If a provision is invalid, others remain in effect.
  • Changes to terms will be communicated in advance.
